Savage Model 12 VLP - Magazine Problem and 5 Rounds .204

Hi All,
Recently I have had a problem with the Magazine on my Savage Model 12 Varminter Low Profile. The 4th round in the magazine (or top round - last loaded round) has been jumping out of the magazine as I push the action forward to chamber a cartridge. If I remember correctly I did read many moons ago on this forum that there was someone else with the same or similar problem.
Has this been a common complaint of the model 12?
Anyway my rifle is under warranty and apparently I have now got a new magazine and the supplier of my rifle and gunsmith who looked it over is happy with the now properly functioning mag - a win for warranties! I'm still yet to test it in earnest but I'm trusting in the gunsmith that all is well.
The specifications of my rifle state that it is a 4 shot magazine, yet in testing to find the problem the gunsmith was loading 5 rounds into the magazine. I was very surprised at this. He seemed to think that the spring tension of the mag was adequate to not stress or pressure the mag into a fault in the future.
What do you guys think - is it fine to stick 5 .204 round into the mag or should I stick to the specifications and load 4?
